Whereas, under Chapter 7A, Section 3 of the MGL, the Office of the comptroller has the authority to “intercept” debts due the Commonwealth of Massachusetts and under said Section 18 that of municipalities,
Whereas, the Office of the comptroller, feels that Cities and Towns are not included in the intercept program,
Be it resolved, that our State Delegation be asked to look into said intercept program and clarify if Cities and Towns are part of the program and if not, to pass legislation to include City and Town Debt. Further, that the term “debt” be defined to include personal property tax and any other fees due the City or town.
Further, that a copy of this resolve be sent to the Advisory Board of the Office of Comptroller to review said policy including its 11/1/06 MMARS Policy: Accounts Receivable-Intercept Policy.
